Sallen v. Corinthians Licenciamentos LTDA
1st Circuit
273 F.3d 14 (2001)
Jay Sallen (plaintiff) registered corinthians.com, subject to the Uniform Domain Name Dispute Resolution Policy (UDRP); Corinthians Licenciamentos LTDA (Corinthians) (defendant), owner of a Brazilian soccer trademark, won a WIPO arbitration forcing Sallen to transfer the domain. Sallen sought a declaratory judgment in district court to regain the domain under the Anticybersquatting Consumer Protection Act (ACPA); the district court found it lacked jurisdiction, reasoning no federal question existed because Corinthians had no intention of suing under the ACPA, and Sallen appealed.
Whether federal courts have jurisdiction to override arbitration decisions made under the Uniform Domain Name Dispute Resolution Policy.
