R.R. (the father) (plaintiff) agreed to pay birth mother M.H. (defendant) $10,000 in installments for conceiving, carrying, and giving birth to a child, with the final installment due only after birth and a clause requiring M.H. to refund the full amount plus expenses if she sought custody or visitation. After conceiving and receiving the final payment, but before giving birth, M.H. told the father she intended to keep the child; she returned only the final installment, and the father sued for breach, with the trial judge ordering the child given to the father and granting him temporary custody.
Whether a surrogacy agreement is valid if money was paid to the birth mother for the purpose of influencing her decision to give up the child.
