Rodriguez v. State
Court of Criminal Appeals of Texas
305 S.W.2d 350 (1957)
Cathalina Gavia accused Rodriguez (defendant) of assaulting her young daughter, and Gavia was the state's sole witness at trial since the child was too young to testify. Rodriguez testified that Gavia fabricated the accusation out of revenge after he told her father he had seen her with another man. The state recalled Gavia to deny the fabrication and introduced evidence of her good reputation for truthfulness in the community. The jury convicted Rodriguez, and he appealed, arguing the reputation evidence was improperly admitted.
Whether evidence of a witness's good reputation for truth and veracity is admissible if the opposing party has cast doubt on the witness's motives or the truth of the witness's testimony.
