Rockingham County (defendant) hired Luten Bridge Co. (plaintiff) to build a bridge. After the board's composition shifted, the County passed a resolution declaring the contract unenforceable and told Luten to stop work, warning that any further work would be at Luten's own risk. At that point Luten had done about $1,900 worth of work, but it kept building and finished the entire bridge anyway, then sued the County for the full contract price.
