Robins Island passed to Parker Wickham by inheritance, but New York confiscated it from him in 1779 because of his loyalty to Great Britain during the Revolutionary War. Over two centuries later, Robins Island Preservation Fund (plaintiff) claimed a 75 percent interest in the island tracing back to Parker Wickham, arguing the confiscation was never properly completed because the British still controlled the island at the time. Southold Development Corporation (defendant) traced its own title to New York's confiscation, and after the district court found New York's title valid, Robins Island appealed.
