Holtsinger conveyed land to a traction company on the express condition that if the company stopped using it for a railroad, title would revert to Holtsinger and his heirs; months later, Holtsinger conveyed a larger tract, including that same land, to Henderson and Gaither, expressly subject to the earlier deed to the company. Years later, the company abandoned the railroad use, and successors of Henderson and Gaither (plaintiffs) sued to quiet title, but the trial court dismissed the complaint, and the plaintiffs appealed.
