Nebraska Supreme Court
61 N.W.2d 350 (1953)
Relevant factsFree
In 1901, Hannah obtained Knutson's oral permission to lay drainage tile across Knutson's land and did so. Ricenbaw (plaintiff) later acquired Hannah's land, and Kraus (defendant) acquired Knutson's; in 1952 Kraus plugged the drain, and Ricenbaw sued. The trial court held Ricenbaw had an easement and the right to enter and maintain it, enjoining Kraus from interfering, and Kraus appealed.
