A stalker shot and killed Amy Boyer after Docusearch, Inc. (defendant), an internet-based investigation service, sold him her birth date, Social Security number, and home and work addresses. Police later found the stalker had run a website discussing stalking and killing Boyer and other violent acts, and he had ordered information about her from Docusearch eight separate times over three months, each time openly providing his own name, address, phone number, and credit-card information. Docusearch supplied the requested information anyway. In the resulting wrongful-death suit, the federal court asked the New Hampshire Supreme Court whether an information broker owes a legally recognized duty to the third person whose information it sells.
