Eagleton (defendant), a baker, contracted with a soup kitchen to give bread loaves of a set weight to poor people who presented tickets, and to submit the tickets to a relieving officer for payment. Eagleton actually supplied underweight loaves while representing on his statements that they met the contracted weight, and the relieving officer paid him based on those false statements. Eagleton was convicted of attempting to obtain money by false pretenses and appealed.
