Reed v. University of North Dakota and The North Dakota Association for the Disabled, Inc.

Jace Reed (plaintiff) played hockey for the University of North Dakota. Before a preseason race sponsored by the North Dakota Association for the Disabled (NDAD) (defendant), Reed signed a waiver assuming responsibility for any injury as part of the race's registration form. Reed was hurt while running the race and sued UND and NDAD for negligence. NDAD argued the waiver barred the claim, and the trial court granted NDAD summary judgment; Reed appealed, arguing the waiver lacked consideration.
