Redarowicz v. Ohlendorf

Donald Redarowicz (plaintiff) purchased a home in 1977 from a couple who had built it the previous year, and after moving in discovered structural problems with the chimney, an adjoining brick wall, and the foundation, which caused recurring basement water leakage; Redarowicz sued the original builder, Ohlendorf Builders (defendant), for breach of the implied warranty of habitability, but his complaint was dismissed on the ground that the warranty did not extend to subsequent purchasers who weren't the original buyers. Redarowicz sought review in the Illinois Supreme Court.
