Ramsey v. Arizona Title Ins. Co.

Ramsey's (plaintiff) escrow instructions described the property as "the west 160 feet of" a described parcel "except road," while the deed drafted by Arizona Title (defendant) described it as "the west 160 feet... as measured at right angles from the Easterly right of way line of Central Avenue... except any portion... within Central Avenue"; the trial court granted Arizona Title summary judgment, finding the two descriptions covered the same property, and Ramsey appealed.
