The Rainbow Warrior Case (1986)
Ruling Pertaining to the Differences Between France and New Zealand Arising from the Rainbow Warrior Affair
19 Reports of International Arbitral Awards 199 (2006)
France sank the Rainbow Warrior, a New Zealand vessel, killing a Dutch national; two French military officers pleaded guilty in New Zealand and received ten-year sentences. France and New Zealand jointly asked the U.N. Secretary-General for an "equitable and principled" ruling on several disputed issues, chiefly whether the French prisoners should be returned to France, with New Zealand seeking $9 million in damages against France's offer of no more than $4 million.
Whether an inquiry submitted to international arbitration may be shaped flexibly in form, function, and scope according to the specific circumstances and requests of the parties.
