Rabideau's (plaintiff) dog Dakota ran across the street toward a police officer's yard, and the officer, a City of Racine (defendant) employee, shot and killed the dog; the parties disputed whether Dakota had attacked the officer's own dog and was snarling before the shooting, or was simply returning home when shot. Rabideau, who witnessed the shooting and later learned of Dakota's death, sued the City for negligent infliction of emotional distress, and the trial court granted the City summary judgment, affirmed by the court of appeals.
Whether, as a matter of public policy, a plaintiff may recover emotional distress damages for negligent infliction of emotional distress based on the death of a family pet.
