In its patent suit against Broadcom (defendant), Qualcomm (plaintiff) repeatedly denied any involvement in a standards body (the JVT) before December 2003, despite an email suggesting earlier involvement and, ultimately, 46,000 electronic documents discovered only after trial confirming that earlier participation; one of Qualcomm's own attorneys had found 21 relevant emails on an employee's computer before trial but did not disclose them to opposing counsel. The jury found Qualcomm's patent claims waived based on the concealed JVT involvement, and the court awarded Broadcom over $8.5 million in attorneys' fees.
