When Barry Bonds hit his record-breaking 73rd home run, Alex Popov (plaintiff) got the ball into his glove but was then attacked and had it dislodged by a mob of surrounding fans; the ball rolled to Patrick Hayashi (defendant), who was not involved in the attack and secured it before being escorted to safety by stadium security.
