Poole v. Perkins
Supreme Court of Virginia
101 S.E. 240 (1919)
Relevant factsFree
W.T. and F.D. Poole (defendants), Tennessee residents at the time, executed a joint promissory note in favor of Melvin Perkins (plaintiff) that was payable at a bank in Virginia, even though it was signed and delivered in Tennessee; all parties later moved to Virginia, which, unlike Tennessee, had no coverture law voiding a married woman's contracts. When the Pooles defaulted, Mrs. Poole argued Tennessee's coverture law governed and voided her capacity to sign the note; the trial court ruled for Perkins.
