After buying a building whose cellar Poggi (plaintiff) leased for storing roughly two hundred barrels of wine, Scott (defendant), the new owner, sold what he believed were empty barrels to two men for $15; the men actually knew the barrels contained valuable wine, stole it, and were later arrested for theft. Poggi sued Scott for conversion, and the trial court granted a nonsuit for failing to prove conversion.
