Pocono Springs Civic Ass'n v. MacKenzie

The MacKenzies (defendants), owners of an unusable vacant lot in a development, tried unsuccessfully to sell or gift the property to Pocono Springs Civic Association (plaintiff), then stopped paying property taxes, resulting in two unsuccessful tax sales, and mailed a notarized statement declaring their intent to abandon the property while refusing further mail there. The Association sued to collect unpaid dues, and the MacKenzies argued they owed nothing because they had abandoned the property; the trial court granted the Association summary judgment.
