P.M. v. T.B.

A married couple (the Ms, plaintiffs) unable to conceive their own child hired T.B. (defendant) as a gestational surrogate, paying her medical expenses and $13,000 after birth to help fund her own fertility treatment; T.B. carried and delivered twin embryos genetically related to the Ms. As the parties' relationship deteriorated, T.B. delivered the twins 13 weeks premature without informing the Ms; one twin died, and when the Ms learned of the birth, they sued for custody of the surviving child. The trial court enforced the surrogacy agreement, terminating T.B.'s parental rights and awarding custody to Mr. M.
