An ultrasound at Fort Madison Community Hospital (defendant) showed fetal head abnormalities that were never followed up on or accurately communicated to Pamela Plowman (plaintiff), who was told everything was fine. Her son, Z.P., was later diagnosed with cerebral palsy, microcephaly, and severe impairments; Pamela alleged she would have terminated the pregnancy had she been properly informed. The Plowmans (plaintiffs) sued for the cost of Z.P.'s care, mental anguish, and lost income; the trial court dismissed, holding Iowa did not recognize wrongful-birth claims.
Whether wrongful-birth claims filed by parents seeking damages for a child born with birth defects are permitted as a type of medical negligence claim.
