Pittsburgh Athletic Company (plaintiff), owner of the Pittsburgh Pirates, granted General Mills the exclusive right to broadcast play-by-play descriptions of games from Forbes Field, which General Mills then sublicensed to NBC for two Pittsburgh radio stations; a rival station, KQV Broadcasting (defendant), nonetheless broadcast Pirates games by stationing paid observers outside the fenced stadium who could view the action from certain vantage points and relay it. Pittsburgh Athletic sought an injunction against KQV's competing broadcasts.
Whether a professional sports team enjoys a property right to sell exclusive rights to broadcast play-by-play descriptions of its games.
