Henderson agreed to sell a repossessed tractor to Thompson (defendant) and told him to pick it up; Thompson did so but did not notify Henderson he had taken the tractor until several weeks later. Hearing nothing in the meantime, Henderson agreed to sell the same tractor to Peterson (plaintiff), who sued Thompson to recover possession. The trial court granted Thompson's motion for nonsuit after Peterson's evidence.
