People v. Sally Mistook
Supreme Court of the State of Imagination
2 Imagination Cases 10 (2004)
Sally Mistook (defendant) reached into her professor's office without stepping inside and took a folder she believed contained the class roster, though it actually held a draft final exam; she testified that in her home state, an "entry" required physically stepping inside, and that a fellow student, Harry Hellpar, told her the plan was legal. She was also charged with trespass related to entering the office and with a strict-liability charge over an abandoned refrigerator. She requested jury instructions on mistake of law for all charges; the trial court refused, and the jury convicted her.
Whether mistakes of law are generally available as a defense to a general-intent crime.
