Robinson (defendant), whose fingerprints were found on a stolen car missing its wheels and tires, admitted that although he had not stolen the car, he helped his friends remove its wheels and tires the day after the theft, at a different location than where the car was originally taken. He was convicted of larceny in the third degree, and the appellate division reversed, holding the asportation of the car (including the wheels and tires) was already complete before Robinson got involved. The state appealed.
