Burleson and a co-conspirator agreed on September 11 to rob a bank, aborted an attempt on September 13 due to too many bystanders while still bringing weapons (an act furthering the September 11 agreement), then renewed their agreement and actually attempted entry into the bank on September 16 before fleeing, resulting in separate conspiracy charges for the September 11 and September 13 agreements plus an attempted armed robbery charge for the September 16 conduct.
Whether an individual can be convicted of multiple counts of conspiracy when the agreements overlap in every way except for the proposed date for the commission of the crimes, and when one of the conspiracies resulted in an actual attempt.
