Cour de Cassation
Cass. Rep., 15 June 1892 [S.1893.1.28]
Relevant factsFree
Boudier (plaintiff) sold manure to a tenant farmer, Garnier-Godard, for use on land leased from Patureau-Miran (defendant); when Garnier-Godard breached the lease by falling behind on rent, Patureau-Miran terminated the lease and took legal possession of the crops Garnier-Godard had planted using Boudier's manure, without ever paying Boudier for it. The trial court ordered Patureau-Miran to pay Boudier for the manure's cost, and Patureau-Miran appealed.
