After Patterson (plaintiff) misrepresented his trade-in debt to dealership Courtesy Autoplex and Courtesy's attempt at formal repossession failed, employee Blair (defendant) tracked down Patterson driving the disputed vehicle and, when Patterson refused to get out, shot out its tires to recover it; the jury found Courtesy vicariously liable for Blair's conduct, but the court of appeals reversed, finding Blair acted outside the scope of his employment, and Patterson appealed.
