Sports agents Walters and Bloom (plaintiffs) secretly signed college football star Brent Fullwood (defendant) to a post-dated representation agreement while he was still playing for Auburn, paying him $8,000 upfront and promising a future commission on his NFL contract, in violation of NCAA rules barring college athletes from signing with agents or accepting payment. After being drafted by Green Bay, Fullwood repudiated the deal in favor of different representation and refused to repay the money; Walters and Bloom sued to collect the payments and their promised commission.
Whether, in New York, an agreement entered into contrary to public policy may be held unenforceable even if the agreement does not directly violate a criminal statute.
