Neu (plaintiff), injured while riding as a passenger when driver Lorna Grant (defendant) crashed during an impromptu race with her husband, sued the Grants; Wyoming's guest statute shielded a host-driver from liability to a passenger absent gross negligence. Neu unsuccessfully moved to strike that defense as unconstitutional but did not object to its denial, did not object to the jury instruction applying the guest statute, and declined to make any post-trial motions after the jury found for the Grants. She then appealed, arguing the guest statute was unconstitutional.
