Negrete v. Allianz Life Insurance Company

United States Court of Appeals for the Ninth Circuit

523 F.3d 1091 (2008)

Relevant factsFree

Negrete (plaintiff) brought a certified nationwide RICO class action and a California class action against Allianz Life Insurance (defendant) over its annuity sales. Several overlapping suits against Allianz were pending elsewhere — in federal court in California and Minnesota, and in Minnesota state court, some of which had begun settlement discussions. The Negrete district court ordered that Allianz could not join any settlement talks affecting Negrete class claims unless Negrete's own counsel ran the talks and the Negrete court approved any deal. Allianz appealed.

IssueFree

Whether a federal district court may enjoin proceedings in a sister federal district court or a state court absent specific congressional authorization, or necessity to protect its own in rem jurisdiction or a pending settlement.
