A truck owned by Nabors Well Services (defendant) collided with a vehicle driven by Martin Soto, killing passenger Aydee Romero and injuring the seven other occupants; the Soto and Romero families (plaintiffs) sued Nabors for negligence, and Nabors sought to introduce expert testimony that seven of the eight vehicle occupants were not wearing seat belts, but the trial court excluded this evidence under a long-standing rule against seat-belt evidence. The jury found Nabors 51 percent at fault and awarded $2.3 million, the court of appeals affirmed, and the Texas Supreme Court granted review on the admissibility question.
