Mother & Unborn Baby Care of North Texas, Inc. v. Texas

Mother & Unborn Baby Care of North Texas, Inc. (defendant), an anti-abortion organization posing as an abortion clinic under the name Problem Pregnancy Center, advertised under 'Abortion Information & Services,' booked appointments with women seeking abortions, gave them incomplete or evasive information, and then displayed graphic abortion images and attempted to talk them out of the procedure once they arrived expecting abortion services. Texas (plaintiff) sued the center under the Deceptive Trade Practices Consumer Protection Act (DTPA), the trial court ruled for the state, and the center appealed, arguing its anti-abortion activities fell outside the DTPA's scope as noncommercial and constitutionally protected speech.
