Juan Moran (plaintiff), trained to operate a Raymond Corporation (Raymond) (defendant)-manufactured forklift only from inside its operator's cage, climbed onto the forklift's side load-lifter to fix trays that had come loose, then reached through a hole in the cage to pull the lever lowering the lift; he was unable to withdraw his arm quickly enough and was injured. Moran sued Raymond in strict products liability, Raymond argued assumption of risk, and a jury found for Moran; Raymond appealed.
Whether a plaintiff who knows a product is in a dangerous condition and proceeds in disregard of this known danger may recover for resulting injuries in a products-liability suit.
