Moody v. Blanchard Place Apartments
Louisiana Court of Appeal
793 So.2d 281 (2001)
Robert Moody (plaintiff) suffered a severe electric shock while cooking in his apartment, when a metal spoon contacted a defective stove owned by Blanchard Place Apartments (defendant); the shock's strength initially prevented him from pulling away, and when he finally did, he stumbled backward and struck his head, neck, and back on the kitchen wall in front of his two daughters. Moody sued Blanchard Place, its property manager, and their insurer (defendants); at trial, competing economists reached substantially different figures for Moody's lost past and future wages using different calculation methodologies, and the jury awarded $60,000 for past lost wages and $100,000 for lost future earning capacity, alongside $32,611 in past medical expenses; all parties appealed the damages award.
Whether special damages must be tailored to the specific circumstances of the plaintiff and supported by evidence.
