Henry Montgomery (defendant) was convicted of homicide committed at age 17 and sentenced to mandatory life without parole under Louisiana law, with no consideration given to his juvenile circumstances at sentencing. Years later, the Supreme Court decided Miller v. Alabama, holding that a juvenile homicide offender cannot be sentenced to life without parole without first considering the juvenile's special circumstances; Montgomery filed a collateral challenge arguing Miller should apply retroactively to his old sentence, but the trial court denied the motion and the Louisiana Supreme Court denied review.
