Miltiadous v. Tetervak

Miltiadis Miltiadous (plaintiff), a Cypriot citizen, and Inna Tetervak (defendant), a Russian citizen, married in Cyprus and had two children born there, but the marriage was marked by Miltiadous's heavy drinking, anger, and physical and emotional abuse of Tetervak, witnessed by the children, leading their daughter to develop PTSD; Cyprus authorities offered Tetervak no meaningful help. After a violent incident during a family visit to the United States, a Pennsylvania court granted Tetervak a temporary restraining order, sole custody, and supervised visitation for Miltiadous, who was arrested after violating the order by contacting Tetervak; five months later, Tetervak and the children were granted permanent U.S. political asylum due to the continuing threat from Miltiadous in Cyprus, and Miltiadous then sought the children's return to Cyprus under the Hague Convention.
Whether, if there is a grave risk of physical or psychological danger to children upon their return to their home country, the trial court will order that they be returned pursuant to the Hague Convention.
