Gladys Miller (plaintiff) had two children from a prior marriage to Ralph Febre, who was in jail when she married Jay Miller (defendant); the children lived with the couple and Jay loved and supported them financially and emotionally as their father, actively opposing Febre's efforts to reconnect with them once Febre was released. When Gladys sought a divorce from Jay and asked for child support from him on an equitable-estoppel theory, arguing his love and care had induced the children's reliance on him, the trial court and appellate court both ordered Jay to pay child support, and Jay appealed.
Whether equitable estoppel may be invoked to impose on a stepparent the duty to support a stepchild after a divorce from the child's natural parent.
