The Basketball Marketing Co. (BMC) (defendant) signed a 16-year-old Darko Milicic (plaintiff) to an endorsement agreement; four days after his eighteenth birthday, Milicic offered to buy out the contract, and BMC refused, so eleven days after turning eighteen he sent a letter withdrawing from the agreement entirely, which BMC also refused to accept. BMC then told Adidas and Reebok it held a valid, enforceable endorsement agreement with Milicic, causing Adidas to halt its own endorsement negotiations with him; Milicic sued for a temporary restraining order, preliminary injunction, and declaratory relief, and the trial court granted the restraining order and injunction, prompting BMC's appeal.
Whether a contract with a minor is voidable if the minor disaffirms it within a reasonable time after reaching the age of majority.
