G.A. Meyer and other property owners (plaintiffs) owned property in a designated fire zone where a local ordinance banned non-fireproof buildings. Seifert and Mahle (defendants) built a non-fireproof building in the zone under a permit issued by the City of Stuttgart and its officials (defendants). Meyer and the other plaintiffs sued in chancery court for an injunction ordering the building's removal, presenting evidence that it created a fire hazard endangering their own property. The chancery court denied the injunction, and the plaintiffs appealed.
Whether an equity court may grant an injunction where a plaintiff has an equitably protectable interest and no adequate legal remedy, even though the enjoined conduct is also prohibited by criminal law.
