Luis Menendez (plaintiff) attended a party at a residential development called Dobson Ranch, managed by a homeowners' association. Paddock Pool Construction Company (defendant) had been hired to design and build a custom pool at Dobson Ranch to the developer's specifications. At the party, Menendez was thrown by coworkers into the shallow end of the pool and suffered spinal injuries. After settling with the homeowners' association, Menendez brought a strict products-liability claim against Paddock. The trial court dismissed that claim.
Whether, to hold a defendant strictly liable under products-liability law, a plaintiff must show that the allegedly defective object or instrumentality is a "product."
