Roderick McKinnon (plaintiff) lent Mr. and Mrs. Roy Benedict (the Benedicts) (defendants) $5,000 to buy a resort neighboring McKinnon's 1,000-acre summer estate, in exchange for the Benedicts' promise not to remove trees or improve the most desirable part of their resort near McKinnon's property for 25 years. Four years later, with the resort struggling, the Benedicts invested $9,000 to build a trailer park and tent camp on that restricted land, prompting McKinnon to seek an injunction, which the trial court granted; the Benedicts appealed.
Whether a court may consider the adequacy of consideration in determining whether to use its equitable powers to enforce an unconscionable contract against the oppressed party.
