Matter of Vincenti
Supreme Court of New Jersey
458 A.2d 1268 (1983)
While representing a client in a child abuse and neglect case, Vincenti (respondent) accused the court of collusion, racism, and cronyism, refused to return a witness's documents despite repeated requests, sent a sarcastic letter accusing the trial judge of irrationality and partiality, and directed name-calling, obscenities, and physical pushing at witnesses, opposing counsel, and other attorneys, while also unnecessarily subpoenaing individuals and attempting to intimidate a witness. A local ethics committee filed a 22-count complaint, the Disciplinary Review Board affirmed findings of unethical conduct, and Vincenti appealed.
Whether a lawyer is likely guilty of ethical violations if he uses aggressive, unnecessary, and disrespectful tactics and discourse in the course of representing his client.
