A-B- (plaintiff), a Salvadoran national, sought asylum based on repeated abuse by her ex-husband, claiming membership in the social group of "El Salvadoran women who were unable to leave their domestic relationships where they had children in common with their partners." The immigration judge denied relief, finding the claimed group didn't qualify as a cognizable social group and that even if it did, her group membership wasn't a central reason for her persecution; the Board of Immigration Appeals reversed and ordered asylum granted, finding A-B-'s group substantially similar to one it had recognized in an earlier decision, Matter of A-R-C-G-. The Attorney General then reviewed the Board's decision.
Whether an individual seeking asylum must establish more than the mere fact that the individual is part of a group that is at risk of being a victim of crime.
