After the plaintiff's Italian construction project encroached on neighbor Anna DiMaio's land, he engaged the defendant to locate DiMaio, who had moved to the United States, and arrange purchase of her property; the defendant did so but took title in his own name, falsely told the plaintiff he'd paid DiMaio $22,000 and needed a $3,000 down payment, when in fact he'd paid DiMaio only $3,000 total. The plaintiff sent the defendant the requested $3,000 and later sued him in Rhode Island, where the defendant lived at the time of suit though he later moved back to Italy. The superior court ordered the defendant to convey the Italian property to the plaintiff, and the defendant appealed.
