After a lawful search of a motel room turned up stolen goods from recent burglaries but not the missing jewelry, gold, and silver, Upton's (defendant) ex-girlfriend called police and reported that Upton's motor home was full of the missing stolen items, that Upton knew about the raid and would soon move the motor home, that he had bought the goods from the motel's occupant, and that she was coming forward because they had broken up. A detective confirmed the motor home's location as she described, applied for and received a search warrant, and Upton later challenged the warrant's constitutionality.
Whether, to issue a search warrant based on an informant's tip, a magistrate must base the finding on conclusive evidence.
