Michael Martindale (plaintiff) and Margo Martindale (defendant), who had become a full-time stay-at-home mother of their four children, divorced, with Margo receiving custody and Michael agreeing to pay $5,000 per month in rehabilitative alimony for seven years. Before that term ended, Margo moved to extend the payments, citing that two of the children had since developed learning disabilities requiring increasing time and attention from her; although Margo had obtained a part-time medical clinic job and recertified as a teacher, she testified the children's needs kept her from working full-time. The trial court extended the $5,000 monthly payments until the youngest child graduated high school, and Michael appealed.
Whether an award of alimony can be modified only upon a showing of a substantial and material change in circumstances.
