Martin v. Martin

Kentucky Court of Appeals

878 S.W.2d 30 (Ky. Ct. App. 1994)

Relevant factsFree

Garis and Peggy Martin (plaintiffs) owned an undivided one-eighth interest in land, with Garis's parents Charles and Mary (defendants) holding a life estate in the remaining seven-eighths and Garis and Peggy holding the remainder. Charles built a mobile-home park on the land and collected rent from it. Garis and Peggy later moved their own mobile home onto one lot without paying rent or contributing to upkeep, then sued for their one-eighth share of the net rents Charles and Mary collected from the other lots. The trial court ordered Garis and Peggy to pay reasonable rent for the lot they occupied, and they appealed that part of the ruling.
