Marshall v. Goodyear Tire & Rubber

United States Court of Appeals for the Fifth Circuit

554 F.2d 730 (1977)

Relevant factsFree

Goodyear Tire & Rubber (defendant) fired William G. Reed, Jr. in violation of the ADEA, and the Secretary of Labor (plaintiff) sued seeking Reed's lost wages and an injunction against further ADEA violations, also presenting some evidence of a separately discriminatory job order placed by a different Goodyear store in Lakeland. The district court found only the one violation, based on the Auburndale store manager's decision to fire Reed, made no finding about a broader discriminatory company policy, and nonetheless entered a nationwide injunction against Goodyear. Goodyear appealed.

IssueFree

Whether a nationwide or company-wide injunction against further violations of the Age Discrimination in Employment Act of 1967 is appropriate only when the proof establishes a company policy or practice violating the statute.
