Mrs. Connolly (plaintiff), at her own request, received a promissory note for the value of her one-half interest in privately-held, non-dividend-paying, high-risk Amdahl Corporation stock assigned to Mr. Connolly (defendant) in their divorce's community-property distribution. After the trial court's award, Amdahl went public and its stock value rose dramatically; Mrs. Connolly, who had custody of the couple's two young children, moved to reopen the judgment, arguing under Marriage of Brigden that the trial court erred by not dividing the Amdahl stock in kind at the time of divorce. The trial court denied her motion, and she appealed.
